When a traffic matter becomes a criminal case

A collision or traffic breach does not by itself settle criminal responsibility. Investigators must identify the rule said to have been violated, the person to whom it applied, the act or omission, the resulting injury or death and the causal connection. Administrative penalties, insurance decisions and civil compensation may proceed on different legal tests.

First evidence to preserve

  • Scene photographs, measurements, CCTV and dash-camera footage
  • Vehicle condition, event data, maintenance history and technical inspection records
  • Emergency call, ambulance, hospital and forensic medical material
  • Alcohol or drug sampling records, collection times, seals and laboratory chain of custody
  • Driver licence, registration, insurance, employment and route documentation
  • Witness locations, lighting, weather, signage and temporary road-control information

Vehicles and digital recordings can be altered, repaired, overwritten or released quickly. A defence lawyer or victim representative should identify preservation requests and independent technical questions before relying on a summary diagram or a single witness account.

Driver, pedestrian and company responsibilities

The relevant duty may belong to a driver, passenger, pedestrian, cyclist, vehicle owner, employer, carrier or person responsible for road works. Commercial cases can also involve driving-time records, dispatch instructions, cargo condition, maintenance decisions and supervision. Job title or ownership does not automatically prove individual criminal responsibility.

Where intoxication is alleged, the time of driving, test method, specimen handling, medication, clinical condition and right to procedural challenge should be checked. Leaving the scene, failure to assist and conduct after the incident require their own factual and legal analysis rather than being treated as part of the collision automatically.

Procedure after a serious accident

Police may obtain statements, inspect or seize a vehicle, request biological samples and commission technical or medical expertise. Before an interview, establish whether the person is a witness, victim or accused and whether legal representation and interpretation are required. The expert question should test the actual disputed mechanism, not simply confirm the investigator’s initial theory.
