An appeal can fail before the merits are considered

The strongest factual defence is ineffective if it is sent to the wrong body, filed late or unsupported by the order and case record. Administrative appeal work therefore begins with formal identification of the decision and a documented filing plan.

Article 271 identifies persons who may appeal, including the person against whom the order was issued and other parties specified by the Code. Article 272 separates routes according to the issuing body and type of penalty. The current order, not a verbal description of the result, determines which route applies.

Article 273 states a general ten-day period for appealing an administrative order. The operative trigger, any special rule and a request to restore a missed period must be checked from the current Georgian text and the documents in the case. Counsel should preserve both the service evidence and proof of the date, method and destination of filing.

Four questions before drafting the appeal

Which body or judge issued the order, and what principal or additional penalty was imposed?

When was the order issued and delivered, and what evidence establishes each date?

Which superior body or court has jurisdiction, and through which issuing body must it be filed?

Does filing suspend enforcement, or does the case fall within a statutory exception?

The appeal file should contain more than the order

  • Complete signed order, fine receipt or on-the-spot decision and every annex
  • Administrative-offence report, arrest or seizure record and hearing minutes
  • Proof of service, envelope, electronic notice, registry record and date chronology
  • Written petitions, objections, rejected evidence and requests made at the first hearing
  • Video, photographs, expert material, witness statements and documents supporting the merits
  • Filing receipt, electronic confirmation, postal record and copy of the submitted appeal

Grounds, relief and enforcement must be coordinated

The appeal should identify the material error rather than merely repeat disagreement with the result. Possible issues include an incorrect legal classification, failure to prove an element, unreliable identification, refusal to consider evidence, lack of notice, interpretation problems, unlawful coercive measures or a sanction imposed without addressing relevant circumstances.

Article 275 contains a general suspension rule for timely appeals but also exceptions, and Article 272 addresses the effect of appealing a court order. Enforcement advice must therefore be taken from the exact order and current provision. Payment, licence, confiscation, detention or surcharge consequences should not be assumed to stop automatically.

Administrative Offences Code

A timely appeal generally affects enforcement, but the Code contains express exceptions and different treatment for particular orders. The appeal body examines the lawfulness and reasonableness of the decision within the applicable procedure.

Do not promise suspension, an oral hearing or a particular review period without checking the order type, the applicable exception and the current consolidated text.
